OVERVIEW
These Terms of Service (“Terms”) apply to your access to and use of the Ocean Beach Brands website and online store (the “Services”). “Ocean Beach Brands,” “we,” “us,” and “our” refer to the store operator. Our store is hosted on Shopify, which provides the ecommerce platform.
By visiting, browsing, or purchasing from our Services, you agree to these Terms and our Privacy Policy If you do not agree, do not use the Services.
1. Access and Accounts
You must be at least the age of majority where you live to use the Services, or have consent from a parent/guardian.
You agree to provide accurate, current, and complete information for purchases and account creation (if applicable). You are responsible for keeping your account credentials secure and for all activity under your account. Accounts may not be transferred or resold.
2. Products and Availability
We try to display product descriptions and images accurately, but colors/appearance may vary by device and settings. We do not guarantee that product appearance will exactly match what is shown online.
We may change product descriptions, pricing, or availability at any time, and may limit quantities or discontinue products without notice.
3. Orders
Submitting an order is an offer to purchase. We may accept, reject, or cancel orders at our discretion (including for suspected fraud, errors, or inventory issues). An order is not accepted until we confirm it and process payment.
Once accepted, cancellations may not be possible. If we cancel or change an order, we’ll attempt to notify you using the contact details provided at checkout.

Purchases are for personal or household use only, not resale or export.
4. Pricing, Billing, and Taxes
Prices, promotions, and discounts may change without notice. The price charged is the price shown at checkout at the time you place your order. Prices may exclude shipping, handling, duties, or taxes unless stated otherwise.
You agree to provide valid payment and billing information, and you authorize us (and our payment processors) to charge your payment method for the total order amount, including applicable taxes and shipping.
5. Shipping, Delivery, and Risk of Loss
Delivery dates are estimates only and not guaranteed. We are not responsible for shipping delays caused by carriers, customs, or events outside our control.
Once the shipment is transferred to the carrier, risk of loss and title pass to you to the extent permitted by law. In the event of damange, we will do what we can on a case by case basis.
6. Intellectual Property
All content on the Services (including text, graphics, images, video, logos, and designs) is owned by Ocean Beach Brands or our licensors and is protected by intellectual property laws. You may use the Services for personal, non-commercial use only. No rights are granted except as expressly stated in these Terms.
“Shopify” and related marks are trademarks of Shopify. Other trademarks belong to their respective owners.
7. Optional Tools and Third-Party Links
We may provide access to third-party tools or links. We do not control these third parties and are not responsible for their content, policies, or practices. Your use of third-party tools and sites is at your own risk.
8. Relationship With Shopify
Our store is hosted on Shopify. However, purchases made through our store are made directly with Ocean Beach Brands. Shopify is not responsible for any aspect of sales between you and us, including any injury, damage, or loss related to products you purchase. You expressly release Shopify and its affiliates from claims arising out of your purchase and use of products.
9. Privacy
Our collection and use of personal information is described in our Privacy Policy Because our store is hosted on Shopify, Shopify also processes certain personal information to provide and improve the Services.
10. Feedback and Reviews
If you submit ideas, reviews, suggestions, or other content (“Feedback”), you grant us a perpetual, worldwide, royalty-free license to use, reproduce, modify, publish, and display that Feedback for any purpose, including commercial purposes, without compensation to you.
You represent that you own or have the rights to submit the Feedback and that it does not violate any law or third-party rights.
11. Errors and Corrections
We may correct errors, inaccuracies, or omissions at any time (including after an order is submitted), and may cancel orders if information is inaccurate.
12. Prohibited Uses
You agree not to misuse the Services, including by violating laws, infringing intellectual property rights, harassing others, submitting false information, sending spam, uploading malicious code, scraping/crawling, or interfering with security features. We may suspend or terminate access for violations.
13. Termination
We may suspend or terminate your access to the Services at any time. You remain responsible for payment obligations incurred prior to termination. Sections intended to survive termination will survive.
14. Disclaimers
The Services and all products are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement, to the fullest extent permitted by law.
15. Limitation of Liability
To the fullest extent permitted by law, Ocean Beach Brands and its affiliates, employees, agents, service providers, and Shopify and its affiliates will not be liable for indirect, incidental, punitive, special, or consequential damages, or loss of profits, revenue, data, or replacement costs arising from your use of the Services or any products purchased through the Services.
16. Indemnification
You agree to indemnify and hold harmless Ocean Beach Brands, Shopify, and our affiliates, officers, directors, employees, agents, and service providers from any claims, losses, damages, liabilities, and expenses (including attorneys’ fees) arising out of your breach of these Terms, violation of law, or misuse of the Services.
17. Severability
If any part of these Terms is found unenforceable, the rest remains in full force and effect.
18. Entire Agreement; Waiver
These Terms and any policies referenced here are the entire agreement between you and Ocean Beach Brands regarding the Services. Failure to enforce a provision is not a waiver.
19. Assignment
You may not assign these Terms without our written consent. We may assign these Terms without notice.
20. Governing Law
These Terms are governed by the laws of the state where Ocean Beach Brands is headquartered, without regard to conflict-of-law principles.
California
Venue and jurisdiction will be in the state and federal courts located in that state/county.
21. Changes
We may update these Terms by posting a revised version on the website. Changes take effect when posted unless otherwise required by law. Your continued use of the Services after changes become effective constitutes acceptance.
